<br />League of Minnesota Cities Information Memo: 5/15/2024 <br />City Special Elections Page 20 <br /> <br />Municipal utility in first <br />class cities. <br />Minn. Stat. § <br />452.11 - .12. <br />City of first class must submit <br />question to voters before <br />acquiring or constructing any <br />public utility. May submit <br />question of certificates at same <br />election. <br />Council must pass ordinance stating <br />question or proposal. Vote must occur <br />within 30 days of ordinance passage. <br />Municipal <br />telecommunications <br />services. <br />Minn. Stat. § <br />237.19. <br />Must submit question before <br />purchase, acquisition or <br />construction. <br />Approval by majority of those voting <br />unless proposal is to construct a new <br />exchange where an exchange already <br />exists, then 65% must approve. <br />Additional tax levy <br />pursuant to this law. <br />Minn. Stat. § <br />275.73. <br />Council shall provide for <br />submission of question on <br />additional levy at a general or <br />municipal election. <br />Notice of election must be given and must <br />state purpose and maximum yearly amount <br />of the additional levy. <br />Tax levy for municipal <br />airport. <br />Minn. Stat. § <br />360.037. <br /> <br />Must submit question on <br />ordinance or resolution to voters <br />unless bonds are authorized by a <br />resolution of the city council <br />adopted by a vote of not less than <br />60 percent of its members. <br />Ordinance or resolution referred to must <br />list amount of levy or bonds. <br />Establishment of merit <br />system. <br />Minn. Stat. § <br />44.02. <br /> <br />Any 2nd, 3rd or 4th class city must <br />submit a question to voters on an <br />ordinance establishing a merit <br />system. <br />See statute. <br />Amendment to merit <br />system. <br />Minn. Stat. § <br />44.03. <br /> <br />No police or fire civil service <br />commission may, by ordinance, <br />exclude a position unless 2/3 of <br />voters so vote. <br />See statute. <br /> <br />28
