� � °� <br /> _� o �, o <br /> s CITY of ORONO <br /> a . � <br /> ', ti <br /> �� G'�' RESOLUTION OF THE CITY COUNCIL <br /> ��kESYi�g'� NO. 5 5 5 1 . <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> denies a variance to Zoning Code Section 78-1279(6); and grants a conditional use permit <br /> per Oroilo Municipal Zoning Code Section 78-1286(d)(2) to allow land alterations <br /> consisting of fill in an amount exceeding 500 cubic yards, subject to the following <br /> conditions: <br /> 1. Council approval is based on the site plan, grading and drainage plans, and <br /> buildirig plans submitted by the applicants and annotated by City staff, attached to <br /> • this Resolution as Exhibit B. Any amendments to the said plans which are not in <br /> conformity with City codes will require further Pla.iuung Commission and City <br /> Council review. <br /> 2. This approval is subj ect to coinpliance with the recommendations of the City <br /> Engineer with regards to grading, drainage and erosion control. Appropriate <br /> erosion control measures shall be in place prior to commencement of fill <br /> irnportation. <br /> 3. Evidence that the proposed drainage easement over the adjacent property at 3155 <br /> North Shore Drive has been granted and recorded with Hennepin County shall be <br /> provided prior to issuance of a building permit for the new residence. <br /> 4. Rain gardens shall be established on the site for purposes of stormwater <br /> management, subject to approval of the City Engineer. A proposed rain garden <br /> design shall be subinitted by applicants and approved by the City Engineer prior <br /> to issuance of a building permit for the new residence. Such rain gardens shall be <br /> constructed on the site and covenants for their maintenance s11a11 be established, <br /> prior to issuance of a Certificate of Occupancy for the new home. <br /> 5.
