The Mayor, the City Clerk, the Finance Director and the Cify Administrator (or iii their absence, the deputy or acting Mayor or City Clerk) are hereby authorized in their discretion at such time, if any, as they may deem appropriate, to execute and deliver the Bond Docuinents in the name and on behalf of the City. � 8. Official Statement. The City hereby consents to the completion of the Official Statement and its circulation by the Underwriter in offering the Bonds for sale and the completion of a final form of the Official Statement to reflect the final terms of the Bonds and the foregoing described agreements; provided, however, that the City has not been requested to and has not participated in the preparation of the Official Statement or reviewed or verified the information in the Official Statement and takes no responsibility for and makes no representations or warranties as to, the accuracy, sufficiency or completeness of such information or the information to be included in the final form of the Official Statement. � 9. Certificates, etc. The Mayor, the City Clerk, the Finance Director and the City Administrator (or in their absence the deputy or acting Mayor, City Clerk, Finance Director or City Administrator) are authorized�in their discretion, at such time, if any, as they may deem appropriate, to prepare and furnish to bond counsel and the purcliaser of the Bonds, when issued, certified copies of all proceedings and records of the City relating to the Bonds, and such other affidavits and certificates as may Ue required to show the facts appearing from the books and records in the officers' custody and control or as otherwise known to them; and all such certified copies, certificates and affidavits, including any heretofore furnished, shall constitute representations of the City as to the truth of all statements contained therein. 10. Nature of City's Obli ations. No covenant, stipulation, obligation, representation, or agreement herein contained or contained in the Bonds or the Bond Documents shall be deemed to be a covenant, stipulation, obligation, representation, or agreement of any Council member, officer, agent, or employee of the City in that person's individual capacity, and neither the Council nor any officer or employee executing the Bonds ' or such documents shall be liable personally on the Bonds or be subject to any representation, personal liability or accountability by reason of the issuance thereof. No provision, representation, covenant or agreement contained in the Bonds or in any other document related to the�Bonds, and no obligation therein or herein imposed upon the City or the breach thereof, shall constitute or give rise to a general or moral obligation of the City or • any charge upon its general credit or taxing powers.
