Dunlcley, husband and wife, <br /> " (hereinafter "Owners") are owners of the property located at 2709 Walters Port Lane within <br /> the City of Orono (liereinafter "City") and legally described as: Lot 4 Block 3 Walters Port, <br /> Hennepin County, Minnesota(hereinafter "the property"); and <br /> WHEREAS, for the purpose of adding a second story to the existing residence <br /> Vogue ICF Homes, Inc. (hereinafter "Applicant") has made application on behalf of the <br /> Owners to the City for variances to Municipal Zoning Code Section 78-1279 to allow a <br /> • lakeshore setback of 30 feet when 75 feet is required and an average lakeshore setback to <br /> allow expansioii of a house entirely forward of the average lakeshore setback; and <br /> WHEREAS, after due published notice and mailed notice iii accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on October 16, 2006, at which times all persons desiring to <br /> be heard concenling this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: . <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#06-3238. <br /> 2. The property is located in the LR-1B zoning district, where 1 acre is the <br /> minimum lot area and 140 feet is the minimum lot width. The property is <br /> approximately 0.4 acres in area and 300 feet in width. <br /> 3. The Planning Commission reviewed tlus application on October 16, 2006 and <br /> on a vote of 5 - 1 recommended approval of the variances subject to the center <br /> pealc being lowered to 28 feet 11 inches,based on the following findings: <br /> a. The slope of the existing roof is very shallow.
