o,�,. <br /> 0 0 <br /> CITY of ORONO <br /> ti <br /> A- <br /> RESOLUTION OF THE CITY COUNCIL`9k'Eg80g�6 NO. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants a conditional use permit per Orono Municipal Zoning Code Section 78-418 (3) <br /> conduct land alterations in the area between the church building and County Road 6, and <br /> to construct a 12' x 24' shed; and grants variances to Section 78-1467 to allow placement <br /> of a sign with 42 s.f. and 10'6"in height, subject to the following conditions: <br /> 1. Council approval is based on the site plans submitted by the applicant and <br /> annotated by City staff, attached to this Resolution as Exhibit B. Any <br /> amendments to the site plan which are not in conformity with City codes will <br /> require further Planning Commission and City Council review. <br /> 2. Any additional lighting beyond that required by the Building Code will require <br /> approval of a separate conditional use permit. <br /> 3. Building permits are required prior to commencement of all of the aspects of the <br /> proj ect. <br /> 4. Prior to issuance of a building permit of the grading portion of the project the <br /> applicant will provide the City with a Developer's Agreement in lieu of a Letter <br /> of Credit for the improvements. <br /> 5. Any and all existing and forthcoming City Engineer recommendations shall be <br /> incorporated into the final plans. <br /> 6. The columbarium is specifically not approved because such approval absent an <br /> amendment of the zoning code would constitute a use variance which cannot <br /> legally be granted. <br /> 7. Authorities granted by this resolution run with the property not with the applicant, <br /> but are permissive only and must be exercised by obtaining a building permit for <br /> the new construction within one year of the date of Council approval, or the <br /> conditional use permit will expire on that date (November 27, 2007). <br /> 8. Violation of or non-compliance with any of the terms and conditions of this <br /> resolution shall constitute a violation of the zoning code, shall automatically <br /> terminate any authority granted herein, and shall be punishable as a misdemeanor. <br /> Page 4 of 6 <br />
