Approximately 35 feet behind the house the property drops sharply to a <br /> wetland area 60 feet below. The view of tlus area would be considered an <br /> amenity to the property. The expanded deck will make it easier for the <br /> applicant to enj oy this view. <br /> d. The deck would not be out of character with the neighborhood or have an <br /> adverse impact on the adjacent property. At its closest point the deck <br /> would be at least 30 feet from the nearest structure on the adjacent <br /> property. This structure is a detached garage. <br /> 4. The City Council has coilsidered this application including the fmdings and <br /> recommendation of the Planning Commission, reports by City staff, comments <br /> by the applicant and the public, and the effect of the proposed variance on the <br /> • health, safety and welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardsliip or difficulty; is necessary to preserve a substailtial <br /> property right of the applicant; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Coinprehensive Plan of the City. <br /> CONCY�USIONS, Ol[tDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a <br /> variance to Orono Municipal Zoning Code Section 78-420(b) to allow a deck with a 10 foot <br /> side setbacic, subject to the following conditions: � � <br /> 1. Council approval is based on the site plan submitted by the applicant and <br /> annotated by City staff, attached to this Resolution as Exhibit A. Any <br /> amendments to the site plan may require further Planning Coirunission and <br /> City Council review. <br /> • 2.
