2. By constructing the existing residence and deck at 19.5% hardcover in the 75' to 250' <br />setback, it is not possible to meet the requirements. <br />3. When construction of the current residence was completed in 1996, drainage patterns <br />were altered resulting in a negative impact to the adjacent property to the north. The <br />temporary certificate of occupancy approved February 21, 1997 states that drainage on <br />the north side of the property must be redirected away from the adjacent property to the <br />north by July 1, 1997 before a final certificate of occupancy will be issued. As of yet, <br />this condition has not been satisfied and the applicant does not have a final certificate of <br />occupancy. <br />4. Hardship was created by the applicant to some degree as the residence constructed in 1996 <br />could have be constructed in a manner to eliminate the need for future variances to construct <br />a garage. <br />5. While the 35' required street setback could be met, this would result in an approximate <br />increase of 315 s.f. of hardcover in the 75' to 250' lakeshore setback, or 32.1% hardcover <br />where staff recommends approval of2^%. <br />-30.\ <br />6 If variances to construct a garage are denied, a paved or gravel driveway will likely be added <br />resulting in a similar amount of hardcover to what is being proposed on the lot. Vehicles and <br />other equipment will also remain stored outside, which may have a negative visual impact <br />on the neighborhood. <br />7. The survey for construction of the house noted that the 64 s.f. shed on the O' to 75' setback <br />would be razed. It remains on the property. <br />STAFF RECOMMENDATION <br />Staff recommends approval of the proposed 648 s.f accessory structure with a dormer above subject <br />to several amendments and conditions. <br />• Staff recommends approval of a variance of 5.1 % to allow 30.1 % hardcover in the 75' to 250' <br />zone where 25% is dlowed and 29% is proposed. This 1.1% increase recommended by staff <br />is to allow for additional driveway required for moving the garage 20' back firom the right-of <br />way. The increase is somewhat offset by the reduction in the length of the proposed <br />sidewalk.
