1. The hardcover requirement in the 75' to 250' lakeshore setback could be <br />met. Denial of the variance would result in the driveway being <br />reconfigured in a manner to meet the hardcover requirement. This option <br />has several negative effects on the property and neighboring property <br />including: significant grading would need to occur to construct such a <br />driveway, headlights would be directed at a the residence across the <br />street, a utility pole would need to be relocated, significant trees would <br />need to be removed. The proposed driveway reuses the existing <br />driveway. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty, is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and wel%e of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a variance to Mimicipal Zoning Code Section 10.22, Subdivision 2 to allow construction <br />of a new residence on a vacant lot requiring a variance for hardcover of .9% in the 75' to 250' <br />lakeshore setback to allow 25.9% where 25% is allowed. <br />Page 2 of 5
