STATEMENT OF HARDSHIP <br />The applicant has stated on ..le application that their hardship for requesting a side yard variance <br />is the location of the existing residence on the property. The chimney is 1.7' from the west property <br />line. The lot narrows from the street to the lakeshore, varying from 65.12' at the street to 49.15' at <br />the lakeshore. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The house can continue to be used without the addition. The proposed addition includes <br />a master bedroom/bath and two additional bedrooms. The existing house has a 1,208.95 sq. <br />ft. footprint. <br />2. The plight of the landowner is dn> to circumstances unique to his property not created <br />by the landowner. <br />The need for a side yard variance is created by the location of the existing structure and the <br />landowner's desire to build an additional floor using the existing foundation and walls. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The variance for a side yard variance will change the bulk of the house by adding a second <br />floor. The height of the building needs to be 30' or less from the street side elevation. <br />Because the topography slopes down towards the lakeshore, the height will be more dramatic <br />.:om the side >ards and lakeshore yard than the street yard. <br />4. Economic considerations alone shall no^ constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />5. The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />Residential uses are allowed in this zoning district. <br />U2346 Mark and Pamela Palm <br />1447 Park Drive <br />March 16. 1998 <br />page—4
