Gaffron > <br />Title: Senior Planning Coordinator <br />Administrator Approval:Agenda Section: <br />Zoning <br />Item Description: #2327 Orono Development, LLC - Proposed Zoning Code Amendment - <br />B-5 Conditional Uses: Bagel and Coffee Retail Stores - Ordinance Adoption <br />Zoning District: B-5 Limited Neighborhood Business District <br />Application: Request to have 'coffee and bagel retail stores' added to the list of allowed conditional <br />uses within the B-5 zoning district. <br />List of Exhibits <br />A - Draft Ordinance <br />B - Notice of Council Action 3/2/98 <br />C - Staff Memo of 2/20/98 <br />Summary <br />On February 23 the Council tabled this item and directed staff to draft a zoning code amendment to <br />allow 'coffee and bagel retail stores' as a conditional use within the B-5 Limited Neighborhood <br />Business District. Staff met with John O'Sullivan and applicant Tom Dillon on March 2 to review <br />the initial draft of the amendment. That discussion resulted in staff revising the draft slightly to <br />accomodate specific square footage needs of the applicant, and also resulted in some good discussion <br />regarding the actual need for detailed restrictions in the B-5, given the limited size and small number <br />of properties in this district. <br />Staff initially suggested the following general conditions: <br />1. Coffee/bagel retail stores shall not be the primary tenant of a building. <br />2. Coffee/bagel retail stores individually or as a joint use shall not e.xceed 40% of the <br />gross floor area of an individual building. <br />3. A coffee or bagel retail store shall not exceed 1,500 s.f. in gross floor area, and a <br />combined coffee/bagel shop shall not exceed 3,000 s.f. in gross floor area. <br />4. Applicant shall demonstrate that the coffee/bagel uses will have adequate parking <br />available per City codes.
