ORDINANCE NO., SECOND SERIES <br />AN ORDINANCE AMENDING SECTION 10.44 OF THE ORONO ZONING CODE <br />BY ADDING COFFEE AND BAGEL RETAIL STORES <br />TO THE LIST OF CONDITIONAL USES <br />WITHIN THE B-5 LIMITED NEIGHBORliOOD BUSINESS DISTRICT <br />The City Council of Orono ordains as follows; <br />Section 1. Municipal Zoning Code Section 10.44, Subdivision 4 (A) is hereby amended by adding <br />the following uses and related standards to the list of conditional uses allowed within the B-5 <br />Limited Neighborhood Business District: <br />CofTee or bagel retail stores, subject to the following conditions: <br />a.No more than 50% of the gross floor area of any single building shall be <br />devoted to coffee and/or bagel retail store uses. <br />No individual coffee or bagel retail store use shall exceed 2,000 s.f. of gross <br />floor area. A combined coffee and bagel retail store use shall not exceed <br />4,000 s.f. of gross floor area. <br />c.The number of incremental parking spaces required for the coffee and/or bagel <br />retail store use jhall be calculated using the zoning code parking requirement <br />standard for restaurant uses. Applicant shall demonstrate that the total parking <br />needs for the site will be met. <br />An individual coffee or bagel retail store use shall be limited to a maximum <br />of 45 seats. A combined coffee and bagel retail store uses shall be limited to <br />a maximum of 60 seats. <br />Section 2. Adoption and Publication. This ordinance shall be published in The Pioneer and The <br />Laker newspapers and shall become effective immediately upon publication. <br />Adopted by the City Council of Orono, Minnesota on this 23rd day of March, 1998 by a vote <br />ayes and ___nays. <br />ATTEST: <br />Linda S.
