According to Heruiepin County plat maps and the survey submitted with <br /> the application, there is a portion of Forest Lane (undeveloped) located <br /> between this property a.nd the lakeshore. It is assumed that this portion of <br /> Forest Lane will be combiiied witli tlie applicants' property at some time <br /> in the future. It has served as the lakeshore access for this lot. Other lots in <br /> the neighborhood have had Forest Lane vacated and a few lots have <br /> combined that portion of property with the residential site. For current <br /> zoning purposes, this lot is being considered a lakeshore lot for setback <br /> purposes even though the legal description and property records do not <br /> include the vacated portion of the road. Tlus is an important distinction <br /> for this property because a non-lakeshore lot would not permit an <br /> accessory building to be located closer to the street than the house. <br /> 4. The City Council finds that the conditions existing on this property are peculiar to <br /> � it and do not apply generally to other property in this zoning district; that granting <br /> the variances will not adversely affect traffic conditions, light, air, nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants, but is necessary to alleviate a demonstrable <br /> hardship or difficulty; is necessary to preserve a substantial property right of the <br /> applicants; and would be in keeping with the spirit and intent of the Zoning Code <br /> and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recominendations of the Planning Commission, reports by City Staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER,AND CONDITIONS � <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Section 78-1288 to permit 3,372 s.f. (33.6%) <br /> hardcover in the 75-250' lakeshore setback zone where 3,812 s.f. (37.9%) exists and 2,512.5 s.f. <br /> {25%) is allowed; to permit �1,534 s.f. (48.6%) hardcover in the 250-500' lakeshore setback <br /> where 1,607 s.f. (50.9%) exists and 946.5 s.f. (30%) is allowed; and a variance to Section 78- <br /> • 1436 to permit a 5' setback where 15'.is required for constniction of a new 25' x 30' (748 s.£) <br /> detached;ara;e to replace an existing detached garage, subject to the following conditions: <br /> Page 3 of 7 <br />
