.ti. <br /> ` O� <br /> K � <br /> O � O <br /> � s CITY of ORONO <br /> a � : - � <br /> , ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`9k'ESH.�4�G No. 5.5 0 8 . <br /> A RESOLUTION REGARDING THE METROPOLITAN COUNCIL <br /> " ENVIRONMENTAL SERVICES (MCES) I/I SURCHARGE PROGR.AM <br /> WHEREAS,the Metropolitan Council Environmental Services (MCES)has adopted an <br /> Infiltration/Inflow Surcharge Program, and determined that the City of Orono experienced at <br /> least one peak flow event between June 2004 and June 2006, on September 4, 2005 that exceeds <br /> the MCES peak flow goal for the City, and ' ' � <br /> WHEREAS, the MCES has proposed that the City of Orono pay an annual surcharge of <br /> $89,600 for a period of five years ($448,000 total), or app�eal the proposed surcharge in <br /> accordance with the provisions of the Surcharge Procedure Manual, and <br /> WHEREAS, the Surcharge Procedure Manual further provides five (5) options for <br /> communities to contest the proposed 2007 surcharge amount, including an option for the City to <br /> • corrimit to an Action Plan to spend funds to identify and rehabilitate UI sources in lieu of paying <br /> the proposed surcharge to the MCES as long as the funds expended are equivalent to the <br /> proposed 2007 surcharge amount, and <br /> WHERAS, the MCES will recalculate the 2008-2011 surcharge amounts based on the <br /> City's 2007 expenditures, the results of the sanitary sewer analysis study, and any larger peak <br /> flow events that may occur in the future, and <br /> WHEREAS,Bonestroo Rosene Anderlik has prepared a letter report dated September 6, <br /> 2006 that documents the 2006 City expenditures for UI identification and rehabilitation that can <br /> be applied to reduce the proposed surcharge amount, and recommends a comprehensive <br /> approach to study the sanitary sewer system and recommend rehabilitation procedures for <br /> reducing future UI. <br /> NOW THEREFORE BE IT RESOLVED,that: <br /> 1. Based on the information provided in the September 6, 2006 Bonestroo Rosene <br /> Anderlik letter report, the City of Orono formally requests that the proposed MCES <br /> UI surcharge amount be reduced by the 2006 UI reduction expenditures already paid <br /> by the City. <br /> 2. The City of Orono is committed to an Action Plan as described in the September 6, <br /> • 2006 Bonestroo Rosene Anderlik letter report, to identify sources of the system UI <br /> Page 1 of 2 <br />
