PROPERTY OCCUPIED BY <br /> WINDWARD I�tARINfi AT 14« SHORELINE DRIVE <br /> SgA,yL gS 11SSESSED TWO SEWER UNITS AS PART <br /> OF SEWER PROJECT 80-1 � <br /> , WHEREAS, the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS , Sewer Project 80-1 was initiated by the City to solve <br /> existing on-site sewage treatment problems in the Minnetonka Bluffs-West <br /> Fern�ale-County Road 15 (Marina) area in which Windward biarine is <br /> l�ocated; and <br /> WHEREAS , the Windward i►iarine operation, located at 1444 Shorelin� <br /> Drive and Iegally described as PINS No. 11-117-23 22 0006 contains a <br /> marina, retail store, and storage buildinq. <br /> THEREFORE BE IT RESOLVED, by the City Cauncil of the City of <br /> OrQno, that: <br /> 1. The above described property known as Windward�Marine is <br /> bene£itted by and shall be assessed for a total .of �wo <br /> sewer units, foz: — <br /> a3 Boat holding tank pumpout. - <br /> b) Commercial Occupancy Building, which use requires <br /> sanitary facilities pursuant to State Building Code <br /> and City marina licensing requirements. <br /> 2 . There exists a storage building on the same lot described , <br /> above (PINS No. 11-117-23 22 0006) but on the East side of <br /> County Road 15 across the highway from the retail sales <br /> building. The Council finds that: <br /> a) •This building is used as an accessory structure for <br /> storage only. There are no existinq sanitary facilitie <br /> No sales or service functions occur in the builfling. <br /> ' No persons are regularly employed on the pzemises . <br /> b) Since it is hereby determined to have accessory use <br /> only, said building vill not be asaessed as an occupiec <br /> unit and cannot be hereafter converted to any principa: <br /> c�r other occupancy requirinq sanitary facilities. <br /> c) If the storage buildinq had had sanitary facilities <br /> � or had otherwiae been used for sales, service or <br /> con�nercinl purposea, it would h�ve been assessed <br /> therefore. <br /> � d) A stub for the boat holding tank will be provided .on <br /> the Browns ' Bay (east) side of the road and a stub <br /> for the commercial building will be provided on the <br /> Tanager Lake (west) side of the road. <br /> Da(:F 1 OF 2 <br />
