l City of ORONO , <br /> RESOLUTION OF THE CITY COUNCIL <br /> NO. `1173 <br /> � • <br /> � _ � � DETERMINING THAT SANITARY SEWSR SERVICE <br /> WILL BE PROVIDED TO VACANT PROPSRTY LOCATED <br /> � ON KEENE AVENUE �CIJONN AS IATS 6, 7, AND 8, <br /> BLOCK 16, MINNETONRA� BLUP'FS <br /> WHEREAS , the City of Orono is a municipal corporation organized <br /> and existing under the laws of the State of Minnesota; and <br /> WHEREAS , Sewer Project 80-1 was initiated by the City to solve <br /> existing on-site sewage treatment problems in the Minnetonka Bluffs-West <br /> Ferndale area, within whieh Lots 6, 7, and 8, Block 16 , Minnetonka Bluffs, <br /> are located; and <br /> WHEREAS, the aforementioned lots 6, 7, and 8 are legally <br /> co:nbined for tax purposes into a single parcel, legally described as: <br /> PINS� 02-117-23 31 0042 Lots 6, 7, and 8 including adjacent <br /> 1/2 of vacated a11ey, Block 16, Minnetonka Bluffs; and <br /> -- WHEREAS , said parcel is under single separate ownership not <br /> owned in common with any other abutting or nearby properties; and____ <br /> WHEREAS,- a11 adjacent lots are occupied; and _ <br /> WHEREAS , t�h.e total dry land area of the parcel is approximately <br /> 0. 52 acres, as compared to the existing zoning regulation requiring 2 . 0 <br /> acres per buildable site; and <br /> WHEREAS, said parcel is not buildable without one or more <br /> variances from the existing zoning code; and <br /> WHEREAS, construction of a si.ngle family residence on the parcel <br /> if done according to �all �oning performance standards, would not be contra <br /> to the intent of the Community Management Plan; and <br /> WHEREAS, failure to provide sewer service would make the parcel <br /> unbuildable because�of insufficient room to provide far house, well, and <br /> primary and future septic system drainfield; and <br /> WHEREAS, sewer will be available in the street or right-of-way <br /> adjacent to the property upon ccxapletion� of sati+�er profect 80-1, <br /> PAGE 1 OF 2 <br />
