� • <br /> C�t� o� ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> � N0. 1166 <br /> • - • • <br /> DECLINING TO VACATE UNIMPROVED STREET AND <br /> PARK PROPERTY IN THE PLAT OF SAGA HTLL REVISED <br /> WHEREAS, the City of Orono, hereinafter "City" , is a <br /> municipal corporation organized and existing under the laws of the <br /> State of Minnesota; and <br /> WHEREAS, the City has received a request from Fred Ryan <br /> and Glen Carlson to vacate in their favor certain unimproved public <br /> property at the intersection of Park Drive and North Arm Drive, <br /> described as the "Park" platted at that intersection and that portion <br /> of platted, unimproved Lafayette Avenue (now Park Drive) lying west <br /> of the "Park" and adjacent to Lots 6, 7 , 8 & 9, Block 7, Saga Hill <br /> Revised, as shown on attached Exhibit A; and <br /> WHEREAS , pursuant to said request and in accordance with <br /> Section 32. 700 of the Orono Zoning Code and Minnesota Statutes Section <br /> 412 . 851, a Public Hearing was held by the Planning Commission on <br /> April 21, 1980, during which hearing testimony was given by at least <br /> - five neighbors regarding current public use of the area by neighborhood <br /> children and their resulting opposition to vacating the property; and <br /> WHEREAS, a review by the Orono Park Commission on May 6, 1980, <br /> resulted in a recommendation to retain the park land and combine it <br /> with the adjacent unused public right of way to create a more feasible <br /> neighborhood park area; and <br /> WHEREAS, the identification and limited development of small <br /> neighborhood play areas is consistent with the policies contained in <br /> the 1980 Community Management Plan, particularly when no new land <br /> acquisition is necessary; and <br /> WHEREAS, the arguments in favor of vacation centered mainly <br /> on complaints of limited maintenance of the area and on noisy and <br /> unauthorized vehicular use of the area, the control of which would be <br /> improved if the area were better defined as publicly owned property. <br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of <br /> the City of Orono hereby refuses and declines to approve vacation of <br /> ' the above referenced public property, finding no public purpose to be <br /> served by such vacation, but on the contrary, finding a current and <br /> ongoing public use of the property which justifies eontinued public <br /> ownership and control. <br /> �. <br /> PAGE l OF � <br />
