� r <br /> __ C�t� o� ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> � NO. 1162 <br /> • ' • • <br /> 6. The special conditions applying to the structure or <br /> land in question are peculiar to such property or immediately <br /> surrounding property and do not apply generally to other <br /> land or structures in the district in which said land is <br /> located. , <br /> 7. The granting of the application is necessary for the <br /> preservation and enjoyment of a substantial property right <br /> , of the applicant. <br /> 8. The granting of the proposed variance will not in any <br /> way impair the public health, safety, comfort, morals or <br /> general welfare. <br /> 9. The granting of the proposed variance will not be <br /> contrary to the intent of the Comprehensive Land Use Plan <br /> or the Zoning Code. <br /> 10. The granting of such variance will not merely serve as <br /> a convenience to the applicant, but is necessary to alleviate <br /> demonstrated hardships or difficulties resulting from the <br /> location of the existing house on the lot. <br /> FURTHERM�RE, BE IT RESOLVED, that based upon the foregoing <br /> findings, the City Council hereby approves the lot area, lot width <br /> and setback variances as requested subject to the following conditions: <br /> 1. Applicant must complete the following requirements before <br /> the City will issue a Certificate of Occupancy: <br /> a) removal of existing, detached garage <br /> b) improvement and addition to existing drainfield � <br /> to be completed. <br /> 2.
