_ contract, or incorporates any information from a document or manual delivered <br /> to it pursuant to the aforementioned license into a publication originating with <br /> the City for dissemination by the City, then, and in such event, the City will <br /> first comply with the provisions of Paragraph 4.01(f) of the contract, as <br /> embodied in Paragraph 4 of this Resolution, and the City will disseminate such <br /> document only to its agents, servants, or employees. <br /> 6. (4.01(h)) The City will indemnify and hold OSI harmless against <br /> any losses, damages, costs, expenses, claims, or actions resulting from or <br /> arising out of any use not authorized by the license granted in the contract of <br /> the computer programs and/or materiats comprising the GEMUNIS/3000 System <br /> by the City, by any agent, servant, or employee of the City, or by any other <br /> person who obtains access through the City to the computer programs and <br /> materials licensed to the City. <br /> �- 7. The City makes the foregoing covenants, which run to the benefit <br /> of LOGIS and to OSI , in fulfillment of the City's obligation under the contract, <br /> and effective as of the date provided therein. <br /> The motion for the adoption of the foregoing resolution was duly <br /> seconded by Councilmember Hurr , and upon vote being <br /> taken thereon, the following voted in favor thereof: Mayor Van Nest, Council- <br /> members Butler, Hurr, and Paurus <br /> and the following voted against: none <br /> � whereupon said resolution was declared duly passed and adopted. <br /> 4 <br />
