The special conditions applying to the structure or <br /> land in question are peculiar to such property or immediately <br /> surrounding property and do not apply generally to other <br /> land or structures in the district in which said land is <br /> located. ' <br /> 7. The granting of the application is necessary for the <br /> preservation and enjoyment of a substantial property right <br /> of the applicant. <br /> 8. The granting of the proposed variance will not in any <br /> way impair the public health, safety, comfort, morals or <br /> general welfare. <br /> 9. The granting of the proposed variance will not be <br /> contrary to the intent of the Comprehensive Land Use Plan <br /> or the Zoning Code. <br /> 10. The granting of such variance will not merely serve as a <br /> - convenience to the applicant, but is necessary to alleviate <br /> demonstrated hardships or difficulties resulting from the <br /> location of the existing house on tYie lot. <br /> FURTHERMORE, BE IT RESOLVED, that based upon the foregoing <br /> findings, the City Council hereby approves the lot area, lot width and <br /> hardcover variance as requested subject to the following conditions: <br /> 1. The new construction must maintain the side yard setbacks <br /> of the existing house; north side yard setback of 10 feet <br /> and south side yard setback of 8.7 feet. - <br /> 2. The Applicant shall sign this resolution and thereby <br /> agree that the proposed removal of a 2 . 5 ft. by 21. 7 ft. <br /> section of the house that encroaches the 75 ft. lakeshore <br /> setback area must be completed no later than July 1, 1981, <br /> or this Variance shall be automatically void, regardless of <br /> the amount of other work actually accomplished by that time. <br /> 3. Al1 construction shall be subject to the requirements of <br /> the State Building Code. <br /> PAG E 2 O F 3 <br />
