. • <br /> Clt� o� ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> � NO. ���� <br /> • � • • <br /> A RESOLUTION ACCEPTING A PERMANENT EASEMENT FOR STREET <br /> PURPOSES ACROSS PROPERTY OWNED BY HENNEPIN COUNTY <br /> WHEREAS, the City of Orono is a municipal corporation <br /> organized and existing under the laws of the State of Minnesota; and <br /> WHEREAS, Hennepin County owns property within the City of <br /> Orono located at 3880 Shoreline Drive over and upon which is built a <br /> private driveway used and maintained by Hennepin County as private <br /> access to their County maintenance station at said address, hereinafter <br /> referred to as the "driveway"; and <br /> WHEREAS, the City has reviewed and approved construction <br /> of a proposed residential duplex on adjacent property owned by <br /> Warren Ortenblad subject to use of said driveway as the only vehicle <br /> access to the Ortenblad property; and <br /> WHEREAS, Hennepin County would not permit such use of the <br /> driveway so long as it was considered the private property of Hennepin <br /> County; and <br /> WHEREAS , Hennepin County has offered to the City a permanent <br /> easement for street purposes over and across said driveway which <br /> would allow access for Ortenblad as approved by the City, <br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of <br /> the City of Orono hereby accepts the offered permanent easement for <br /> street purposes over and across the following described property owned <br /> by Hennepin County: <br /> The east 50. 00 feet of the west 200. 00 feet of the north <br /> 200. 00 feet of the south 233. 00 feet of that part of <br /> Government Lot 8, Section 17, Township 117, Range 23, <br /> lying east of the east line of "Streater' s Spring Park <br /> Addition" , Hennepin County, Minnesota <br /> subject to the following conditions and agreements: <br /> 1. Hennepin County Department of Transportation has <br /> agreed to continue to maintain said driveway. <br /> 2. The City of Orono will post no parking signs on <br /> said driveway and enforce such no parking restrictions. <br /> PAGE 1 OF 2 <br />
