. • Clt� o� ORONO RESOLUTION OF THE CITY COUNCIL � NO. �� • � • • A RESOLUTION ACCEPTING A PERMANENT EASEMENT FOR STREET PURPOSES ACROSS PROPERTY OWNED BY HENNEPIN COUNTY WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, Hennepin County owns property within the City of Orono located at 3880 Shoreline Drive over and upon which is built a private driveway used and maintained by Hennepin County as private access to their County maintenance station at said address, hereinafter referred to as the "driveway"; and WHEREAS, the City has reviewed and approved construction of a proposed residential duplex on adjacent property owned by Warren Ortenblad subject to use of said driveway as the only vehicle access to the Ortenblad property; and WHEREAS, Hennepin County would not permit such use of the driveway so long as it was considered the private property of Hennepin County; and WHEREAS , Hennepin County has offered to the City a permanent easement for street purposes over and across said driveway which would allow access for Ortenblad as approved by the City, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby accepts the offered permanent easement for street purposes over and across the following described property owned by Hennepin County: The east 50. 00 feet of the west 200. 00 feet of the north 200. 00 feet of the south 233. 00 feet of that part of Government Lot 8, Section 17, Township 117, Range 23, lying east of the east line of "Streater' s Spring Park Addition" , Hennepin County, Minnesota subject to the following conditions and agreements: 1. Hennepin County Department of Transportation has agreed to continue to maintain said driveway. 2. The City of Orono will post no parking signs on said driveway and enforce such no parking restrictions. PAGE 1 OF 2
