MINUTES OP THE ORONO COUNCIL MEETING NOVEMBER 21, 1989 <br />#1457 WALTER PEMBERTON <br />.1702 SBADYHOOD ROAD <br />VARIANCE <br />SECOND <br />and Mrs. Pemberton were present for this application. <br />City Administrator Bernhardson informed the Council and <br />Mayor Grabek of the issues involved with this application. <br />Mrs. Pemberton explained that the dining room was too small <br />for the size of the house. She said there is no room in the <br />kitchen to eat and the dining room will not accomodate a family <br />sit down dinner very well. <br />CounciImember Goetten asked what the size of the dining room <br />Assistant Planning and Zoning Administrator Gaffron said <br />that the dining ror.. is approximately 10' x 13'. <br />Bernhardson noted that by constructing the addition 7' to <br />the side, a 3' side yard variance would be required and there <br />would still be a portion of the addition in the 0-75' setback <br />area. <br />Mrs. Pemberton said that the addition being proposed is very <br />complimentary to the design of the house. <br />Bernhardson informed the Council and Mayor Grabek that 1710 <br />Shadywood Road, adjacent to the Pemberton's, hardcover in the 0- <br />75' zone is 17.5% compared to 22.5% and 29% in the 75-250' zone, <br />compared to the Pembertons' 52.03% The residents of 1710 <br />requested to increase hardcover in the 75-250' to 43% and the <br />City denied their request and required them to remove an existing <br />garage. The residence of Mr. Jack Rhode, 2 homes to the <br />north, was within 55’ of Lake Mi.'netonka and pulled it back to <br />61', using only a portion of the existing foundation to rebuild. <br />His proposal was 13% hardcover in the 0-75 and 24% in 75-250' <br />zone. <br />It was moved by CounciImember Nettles, seconded by <br />CounciImember Goetten, to deny application #1452. CounciImember <br />Callahan asked what the Planning Commission had recommended. <br />Gaffron replied they had recommended approval with a 4 to 2 vote. <br />Mrs. Pemberton said they were being punished for something they <br />did not do. She said they did not put in the deck, driveway cr <br />plastic. She said they were improving the architectual design of <br />the house. CounciImember Goetten said that she as not faulting <br />the Pembertons for the situation that existed w len they bought <br />the property. Goetten said that the problem involves not <br />allowing the situation to continue or worsen. Goetten offered <br />the Pembertons the option of tabling the application to explore <br />other options. Mr. Pemberton asked what other options they had? <br />Goetttn said that perhaps there were no others. Mr. Pemberton <br />said that the title to the house should reflect the condition of
