MINUTES OP THE ORONO COUNCIL MEETING OF DECEMBER 11, 1989 <br />ZONING PILE «1289-PETERSON CONTINUED <br />Nettles asked what problems had been encountered with Mrs. <br />Belt's fence that had been located in the right-of-way? <br />Gerhardson said that maintenance requirements differ from <br />year to year. <br />It was moved by Mayor Grabek, seconded by CounciImember <br />Nettles, to move the fence back out of the right-of-way by June <br />30, 1990 and present a plan to the City for the remainder of the <br />fencing on the property by May 1, 1990. CounciImember Goetten <br />asked at what height the fence being removed from the right-of- <br />way could be re-installed? Mayor Grabek said 5'. CounciImember <br />Nettles said that he would probably vote against this because he <br />does not believe the fence should be moved out of the right-of- <br />way. He said that the fence has been in that location for many, <br />many years and has not caused any problems. CounciImember <br />Callahan said that he does not believe stuctures should be <br />allowed in the public right-of-way. CounciImember Goetten <br />concurred. Motion, Ayes=»3, Goetten, Nettles, Nay. <br />#1471 DARYLB UPHOFF <br />2699 KELLY AVENUE <br />CONDITIONAL USB PERMIT <br />RESOLUTION #2737 <br />Mr. Uphoff was present for this matter. <br />City Administrator Bernhardson explained this application <br />for a conditional use permit to repair a sea wall. <br />It was moved by CounciImember Callahan, seconded by <br />CounciImember Nettles, to adopt Resolution #2737, approving the <br />conditional use permit for repairing a sea wall at 2699 Kelly <br />Avenue.
