3. Withholding: On any contract requiring the employment of <br />provisions of Section 290.92. <br />4. Time for Receiving Proposals; Proposals received prior to <br />the time of opening will be securely kept unopened, ^^e City <br />emploiee whose duty it is to open them will <br />specified time has arrived and no proposal received thereafter <br />will be considered. Proposals received after the time set for <br />opening will be returned to the proposal unopened. No <br />rLponsibility will be attached to a City <br />premature opening of a proposal not properly addressed and <br />identified. <br />5- Minnesota State Sales Tax Exemption: Instrumentalities of <br />the State of Minnesota are not subject to^he State of Minnesota <br />Sales Tax. Pursuant to Minnesota Laws of 1967, Extra Session, <br />Chapter 32, Article XIII, Section 25 (which deals with <br />exemptions), Subd. 1. Para. (J) provides specific exemption from <br />taxes Imposed by Articles XIII as follows: "The gross receipts <br />from all sales of tangible personal property to, and all storage <br />use or consumption of such property by, the Onited States and its <br />agencies and instrumentalities of the State of Minnesota and its <br />agencies, instrumentalities and political sxibdivisions. <br />6. Collusion of ProDoser«3: Collusion between proposers is cause <br />for rejection of all proposals thus involved. <br />7. Guarantee: The successful proposer(s) agree(s) to ,guarantee <br />all materials, parts and supplies <br />requirements, such guarantee to be unconditional, /allure or <br />nealect of the City to require compliance with any term or <br />condition of the contract or requirements shall not be deemed a <br />waiver of such term or condition. <br />8. Delivery: Cosb of delivery to the locatiori o^f^ said m^t^erials <br />and supplies is included in said prices and <br />made only as called for in the contract. It is <br />the Citv shall be under no obligation for payment for any <br />supplies or material except on the basis of <br />addition, the successful proposer(s) shall not be held <br />responsible for damages caused by delay or f®^jt"’^?-tandY^of“the defaults caused by public carriers, or acts or demands of the <br />Government in time of war or national emergency.
