6. The City Council finds that granting a conditional use <br />permit to allow the proposed grading and retaining walls in <br />the 0-75' zone will not be detrimental tc the health, safety <br />or general welfare of the public, would not adversely affect <br />light, air nor pose a fire hazard or other danger to <br />neighboring properties, nor will it depreciate surrounding <br />property values and that the proposed level of use of the <br />property will be in keeping with the intent and objectives <br />of the Zoning Code and Comprehensive Plan of the City. <br />COMCLOSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono <br />City Council hereby grants variances to Municipal Zoning Code <br />Sections 10.22, Subdivisions 1 and 2 and 10.55, Subdivision 8 to <br />permit construction of a greenhouse addition and retaining walls <br />in the 0-75' lakeshore setback zone, resulting in an increase in <br />hardcover from 5.7% to 7.6% in the 0-75' zone where no hardcover <br />is normally allowed, resulting in additional structure in the 0- <br />75' zone where no structure is normally allowed, resulting in an <br />average lakeshore setback encroachment of approximately 125'? and <br />further grants a conditional use permit for grading and retaining <br />walls in the 0-75' lakeshore setback zone per Section 10.03, <br />Subdivision 19, subject to the following conditions: <br />1. Applicant shall provide the City Engineer with a detailed <br />final grading and retaining wall plan, which must be <br />approved before permits can be issued for the <br />grading/retaining wall construction. The City Engineer <br />shall work in conjunction with the applicants to establish <br />suitable limits for the grading work. <br />2. The applicants shall maintain existing vegetation on the <br />lakeshore bank as proposed, and shall plant additional <br />vegetation to screen the proposed 24"-30" high retaining <br />wall from the lake to reduce its visual impact. Applicant <br />shall use native materials and natural coloring to minimize <br />the visual impact of this wall to the greatest extent <br />possible. <br />3. As proposed, applicants shall construct a draintile <br />system between the existing residence and the lakeshore, to <br />redirect the drainage from the 0-75' zone to the 75-250' <br />zone for dispersal. <br />Page 3 of 6
