which are beyond Grantee's control then the cost of said test shall be borne by <br /> City. <br /> (4) FCC Reports. Upon request, the results of tests required to be filed by Grantee <br /> with the FCC shall also be copied to City within ten(10) days of the conduct of the <br /> date of the test. <br /> (5) Emergency Alert Capability. At all times during the term of this Franchise, <br /> Grantee shall provide and maintain an Emergency Alert System (EAS) consistent <br /> with applicable federal law and regulations including 47 C.F.R., Part 11, and any <br /> Minnesota State Emergency Alert System requirements. The City may identify <br /> authorized emergency officials for activating the EAS consistent with the <br /> Minnesota State Emergency Statewide Plan("EAS Plan"). The City may also <br /> develop a local plan containing methods of EAS message distribution, subject to <br /> Applicable Laws and the EAS Plan. Nothing in this section is intended to expand <br /> Grantee's obligations beyond that which is required by the EAS Plan and <br /> Applicable Law. <br /> (6) Stand-by Power. Grantee shall as necessary to operate the system, maintain <br /> standby power system supplies,rated for at least two and one-half(2.5)hours <br /> duration at all optical Node locations in the distribution network. <br /> (7) Parental Control Lock. Grantee shall provide, for sale or lease,to Subscribers, <br /> upon request, a parental control locking device or digital code that permits <br /> inhibiting the video and audio portions of any Channels offered by Grantee. <br /> SECTION 5 <br /> SERVICES PROVISIONS <br /> (1) Rate Regulation. The City reserves the right to regulate rates for Basic Cable Service and <br /> any other services offered over the Cable System, to the extent not prohibited by <br /> Applicable Laws <br /> (2) Consumer Protection and Customer Service Standards. Grantee shall comply with the <br /> consumer protection standards attached hereto as Exhibit D under Normal Operating <br /> Conditions. <br /> SECTION 6 <br /> PUBLIC ACCESS PROVISIONS <br /> (1) Public, Educational and Government Access. City or its designee is hereby designated to <br /> operate, administer, promote, and manage public, educational, and governmental <br /> programming (hereinafter "PEG Access") for the Cable System established pursuant to <br /> this Section 6. Grantee shall have no responsibility whatsoever for PEG Access except as <br /> expressly stated in this Section 6. <br /> (2) Grantee Support for PEG Usage.
