1. All hardcover removals in the 75-250' setback area are <br />to be completed prior to footing inspection by the Orono <br />Building D'partment for new construction. Existing <br />hardcove eas scheduled for removal are shown on survey <br />and attai.:*. d rs Pagt- 6 of this resolution. The hardcover <br />removals as follows: <br />a. 361.8 s.f. of landscaped area underlain with <br />plastic to east side or street side of house. <br />b. 200 s.f. of landscaped area underlain with plastic <br />on south side of house. <br />c. 480 s.f. of gravel off-street parking area <br />adjacent to Casco Point Road. <br />2. Applicant to file for an after-the-fact/penalty building <br />permit for second story lakeside deck constructed sometime <br />in 1982. The City will require penalty fee payment upon <br />issuahce of building permit. <br />3. Authorities granted by this resolution run with the <br />property not with the applicant, but are permissive only and <br />must be exercised by application for a building permit <br />within one year of the date of Council approval, or this <br />variance will expire on that date (September 10, 1991). <br />4. Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of <br />the zoning code, shall automatically terminate any authority <br />granted herein, and shall be punishable as a misdemeanor. <br />5. The undersigned applicant has read, understood and <br />hereby agrees to the terms of this resolution and on behalf <br />of himself, his heirs, successors and assigns, hereby agrees <br />to the recording of this resolution in the chain of title of <br />the property. <br />Page 3 of 6
