A RESOLUTION GRANTING <br />VARIANCES TO <br />HUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 & 2 <br />PILE 1493 <br />WHEREAS, Chuck Downey (hereinafter "the applicant") is <br />the owner of the property located at 2665 Casco Point Road within <br />the City of Orono (hereinafter "City") and legally described as <br />Lot 136, Spring Park, Hennepin County, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, the applicant has applied to the City for an <br />after-the-fact variance to Municipal Zoning Code Section 10.22, <br />Subdivision 1 to permit a deck constructed in front of the <br />average lakeshore setback line where no encroachment is allowed <br />and per Section 10.22, Subdivision 2 seeks approval of hardcover <br />variances within the 75-250' setback area for a proposed 19' x 6' <br />entry addition resulting in 114 s.f. of structural hardcover <br />where theje already exists 4,990.1 s.f. or 59.94% of hardcover <br />within the 75-250' setback area where only 25% is allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File 1493. <br />2. The property is located in the LR-IC Single Family <br />Lakeshore Residential Zoning District requiring 21,780 s.f. <br />or 1/2 acre in area. The property consists of 12,850 s.f. <br />or .29 acres. <br />3. The Orono Planning Commission reviewed this application <br />on August 20, 1990 and recommended approval of the proposed <br />variances based upon the following findings: <br />Hardcover 75-250' <br />A) Excessive hardcover results from landscaped areas <br />underlain with plastic that was not considered <br />hardcover at the time a 1982 survey was completed. <br />Page 1 of 6
