Zoning File 1493 <br />September 6, 1990 <br />Page 2 <br />obviously placed in front of an average lakeshore setback line. <br />Council stated a revised updated survey would be required before <br />Council would act on the improvement plan. <br />The applicant has filed a land alteration conditional use <br />permit with the City ( 15/0). Review Exhibit E. An updated <br />survey has been submitted. The applicant proposes three tiers of <br />retaining walls and extensive cutting into the existing lakeshore <br />banks to solve erosion problems within the lakeshore yard. <br />Planning Commission tabled all action on this phase of the <br />application based on the magnitude of the proposal and the fact <br />that the improvement would be in complete conflict with previous <br />actions of the City. In fact, Planning Commission pointed out <br />specific areaoi where erosion was found and advised applicant to <br />amend th^* proposal under the guidance of the Orono staff. <br />Planning Commission further directed that the variance phase of <br />the application could be acted on as there appeared to be no <br />connection between the entry addition and the proposed land <br />alterations within the lakeshore yard. The variance application <br />is presented for Council's consideration and action. <br />1. Section 10.22, Subdivision 1 - After-the-fact average <br />lakeshore setback variance for second story deck constructed <br />sometime in 1982. Note the entire second story deck is <br />located in front of the average lakeshore setback line. <br />Planning Commission recommended approval of the after-the- <br />fact variance. <br />2. Section 10.22, Subdivision 2 - Hardcover var unce review <br />required because there already exists excessive amounts of <br />hardcover over the allowed 25%. <br />75-250' Setback Aiea = 8,325 £ <br />Existing Hardcover = 3,76 ’. or 45% per 1982 survey <br />Existing Hardcover - 4,990.. .f. or 59.94% per 1990 survey <br />(refer to Exhibits E & H) <br />Proposed Herdcover * 3,979.3 s.f. or 47.7% <br />(refer to Exhibit I) <br />Removal of 1,. s.f. and addition of 30 s.f.
