A <br />review of the application finds that this deck with railing is considered <br />as an encroachment into the required 50' front yard, and therefore cannot <br />be permitted unless a variance is granted. Also, because a 50' setback is <br />also required from your north lot line along Lakeview Avenue, it appears <br />that no portion of the deck can be approved without a variance. <br />Because the deck has already been partially constructed, <br />would be as follows; <br />your options <br />1. Remove the deck in its entirety. <br />OR <br />2. Remove all portions of the deck that have platform height more <br />than 30" above grade and remove railings from the portion that remains <br />or lower the deck so that it doesn't need a railing. A platform deck <br />which does not extend above the main floor level and which does . ot <br />need railings, would not have to meet setbacks. This would eliminate <br />the portion over your old garage, but might allow some deck to remain <br />near the front entry area. <br />3. Apply for a front and side street setback variance. The cost of <br />variance application is $175.00, and your application and the required <br />subm’ttals would have to be in by 12:00 noon, ?*• ...day, July 27th to <br />meev ' next Planning Commission deadline. <br />A building permit cannot be issued for the structure and you must <br />cease work on it until this matter is resolved.
