5. The existing structural improvements on Lots 1 and 3 meet <br />the required setback from the newly proposed division lines. <br />6. Existing hardcover on Lots 1 and 2 shall be maintained at <br />either 25% or less. Lot 2 shall be allowed 4,732 s.f. or <br />25% hardcover v;ithin the 75-250' setback area. <br />NOW, THEREFORE BE IT RESOLVED, that based upon one or <br />more of the findings noted above, the City Council of the City of <br />Orono hereby approves the preliminary plat application of Carol <br />J. Kelly and James Massey for the properties located at 3020/3030 <br />Casco Point Road per the survey originally dated May 21, 1990, <br />most recently revised September 4, 1990 by Pete J. Knabb of Ron <br />Krueger & Associates Inc., subject to the following conditions: <br />1. The following improvements must be completed prior to <br />final plat approval: <br />A) Realignment of drainage ditch as shown on survey <br />noted above. <br />'B) Removal of 398 s.f. of existing hardcover on <br />proposed Lot 1 as shown on the survey noted above <br />(revise date 9/4/90). Prior to final plat approval, <br />applicant's surveyor to submit a revised plan showing <br />existing hardcover removals at 398 s.f., the current <br />plan shows 330 s.f. <br />2. Upon application for a building permit for new <br />construction on Lot 2, the future owner shall pay the <br />following sewer and water fees: <br />Sewer Unit Charge <br />Water Unit Charge <br />$1,513.86 <br />1,691.78 <br />It should also be noted that this rate is based on the 1990 <br />Fee Schedule and will be adjusted based on the inflationary <br />rate for each annual fee schedule. <br />Page 2 of 4
