A RBSOLOTION GRANTING <br />A CONDTIONAL USB PBRMIT <br />PBR MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 AND <br />SECTION 10.55, SUBDIVISION 9 (B) (3) AND <br />VARIANCES TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 2 AND <br />SECTION 10.55, SUBDIVISION 8 <br />FILE 1572 <br />WHEREAS, Guenther and Gertrud Noelting (hereinafter "the <br />applicants) are the owners of the property located at 1060 Ton)cawa <br />Road within the City of Orono (hereinafter "City") and legally <br />described as Lot 1, Block 1, Ryanwood, Hennepin County, Minnesota <br />(hereinafter "property"); and <br />WHEREAS, the applicants have made application to the City of <br />Orono to permit the installation of a permanent dock per Municipal <br />Zoning Code Section 10.03, Subdivision 19 and Section 10.55, <br />Subdivision 9 (B) (3) and variances to Section 10.22, Subdivision 2 <br />and Section 10.55, Subdivision 8 to allow excavation of the lakeshore <br />to permit the installation of support ties to maintain 6' x 12' dock <br />section cantilevered from lakeshore bank; <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File 1572. <br />2. The property is located in the LR-lB Single Family Lakeshore <br />Residential Zoning District requiring 1 acre in area. The <br />property consists of approximately 1 acre in area. <br />3. The Orono Planning Commission reviewed this application on <br />August 20, 1990, and recommended approval of the proposed <br />variances and conditional use permit as proposed based on the <br />following findings and hardship: <br />a.
