RESOLUTION #243 A RESOLUTION'ORDERING.ACQUISITION OF EASEMENTS BY CONDEMNATION FOR 1968 OLD CRYSTAL BAY ROAD IMPROVEMENT PROJECT '• WHEREAS., on .June 10, 19681.1in accordance with the laws of the State of Minnesota; __.the Village -Council_. of Orono has ordered the construction of the 1968 Old Crystal Bay Road Improvement Project, and hereinafter called the Improue.men.t; ..and_._ ___ . WHEREAS, the Village.Council-by resolution has approved the detailed plans and specifications prepared by William T. Mills for construction of the Improvement; and WHEREAS., these approved -plans indicaae and require that certain _.temporary..construction-easements for construction of slopes and other temporary construction-purpos.es:be-acquired in order to complete and construct. -the-. Improvement;.. and... WHEREAS; at.the,direction of said William T. Mills and by authoriza- ...tion of the._Village.'Council Gordon. R.. Coffin, ,surveyor, prepared from said .-.approved-plans.-and by.a survey of the premises described in said plans, `descriptions of such easements that must be acquired in order to complete and.,.construct. the. Improvement.; and_ ' WHEREAS., the village attorneys have prepared appetition to the District Court -of and for the County of Hennepin, State of Minnesota, for th'e acquisition by condemnation of certain of said easements; and WHEREAS, a true and correct copy of said petition is attached hereto and is on file in the office of.the Village Clerk; and WHEREAS, the description of said easements are attached to said petition and hereto as exhibits Nos. 1 through 7, inclusive, said easements are therein designated as parcel numbers 3, 4,�8, 12, 23, 25, 26, and 27; and F. WHEREAS., the easements sought in said petition are necessary and incidental to -the" construction -.of the Improvement; and WHEREAS, the easements sought in said petition are those easements designated, set forth and -required by the approved plans of William'T. Mills,,.! referred to above; NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village-., of Orono, Minnesota as follows:. 1. Those temporary construction easements required for the completion and construction of the Improvement as such -.. are indicated by the approved plans referred to.above and as such are'des.cribed in the attached petition with . exhibits numbers.1..through 7, inclusive, attached thereto and designated.therein as parcel Nos. 3, 4, 8, 12, 23,'. 25, 26, and.27.shall.hereby be acquired by purchase of condemnation, and further the Mayor of the Village of Orono shall be and is hereby authorized to execute the said petition for acquisition by condemnation a copy „ of which is attached'hereto and further the village attorneys shall be and are hereby authorized to commence the condemnation proceedings contemplated by said petition.
