Date: December 9, 2024 Item: 7 <br />Presenter: Adam Edwards, City Administrator / Engineer <br />Section: Consent Agenda <br /> <br />Title: Agreement - Franchise for Cable Services <br /> <br /> <br />1.Purpose: <br />The purpose of this council item is to adopt the franchise agreement withe MIDCO. <br />2.Background: <br />Midco submitted an application to enter into a franchise agreement with Orono, which will give <br />the private company rights to use public property in order to provide its services to residents, <br />giving residents a second option for television, internet, and phone services. <br /> <br />State statute (below) guides the franchise agreement process, including a public hearing, which <br />was held at the last council meeting November 25. Two people provided comments on the project. <br />3.Process: <br />The process of establishing a franchise agreement ordinance is established in Minn. Statute <br />238.081 is: <br /> Franchising authority (City) must publish once a week for two successive weeks a notice of <br />intent to consider an application for a franchise, <br /> City must mail copies of the notice of intent to franchise to any person it has identified as <br />being a potential candidate for the franchise, <br /> Proposals for a cable communications franchise must be notarized and contain the <br />following information: <br />Plans for channel capacity, including both the total number of channels capable of <br />being energized in the system and the number of channels to be energized <br />immediately, <br />Statement of the television and radio broadcast signals for which permission to carry <br />will be requested from the Federal Communications Commission, <br />Description of the proposed system design and planned operation, including at least <br />the following items: <br />general area for location of antennae and the head end, if known, <br />schedule for activating two-way capacity, <br />type of automated services to be provided, <br />number of channels and services to be made available for access cable <br />broadcasting, <br />schedule of charges for facilities and staff assistance for access cable <br />broadcasting. <br />Terms and conditions under which particular service is to be provided to <br />governmental and educational entities, <br />Schedule of proposed rates in relation to the services to be provided, and a proposed <br />policy regarding unusual or difficult connection of services, <br />Time schedule for construction of the entire system with the time sequence for wiring <br />the various parts of the area requested to be served in the request for proposals, <br />AGENDA ITEM <br /> <br /> <br /> <br /> <br />64
