Water Structures anu Ea'/ironment Committee August 11, 1990 <br />6. Tonka Day Marina (Tonka Day) <br />Tonka Bay Marina is considering applying for a change in the <br />location of slip Cl to the dock opposite slip SV9 because the Cl <br />location interferes with the use of the ramp. <br />Boswinkel moved, Bjorlin seconded, to recommend a temporary <br />low water variance to allow Tonka Bay Marina to change the <br />location of slip Cl to the dock opposite slip SV9. Motion <br />carried unanimously. <br />It was recommended that if Tonka Bay Marina wants a <br />permanent change, they indicate it on the application for 1991. <br />Rascop suggested signing and roping off the location at the ramp <br />so it cannot be used. <br />7. Deicing Application Progress Status <br />Thibault reported the 1990/1991 deicing appiicatioris will be <br />sent out the week of August 13. <br />Rascop was excused. <br />8. Fee Study <br />The Board has referred a study of the E.A.W. application and <br />deposit fees to the Water Structures Committee. <br />Pillsbury moved, Bjorlin seconded, to recommend the <br />following sub-committee to study the fee schedule: Jan <br />Boswinkel, Robert .Rascop and James Grathwol. The staff is to <br />prepare background information. Motion carried unanimously. <br />9. "Peterson Structure”, Smithtown Bay, Victoria <br />Thibault reported the DNR has an interest in pursuing an <br />after-the-fact violation of shoreland regulations on property in <br />Victoria identified as the "Peterson Structure". No action was <br />taken, Grathwol offering to follow up on the matter. <br />10. Excelsior Day Associates/Exceisior Day Gables <br />Gi, ' reported a technical violation of LMCD ordinances <br />resultii- from the purchase by the Excelsior Bay Gables <br />Homeowners Association of the multiple docks licensed to <br />Excelsior Bay Associates. The docks are licensed as commercial <br />docks, although they no longer meet the code definition of <br />commercial dock.s. There is also the technicality of licensing <br />the docks on an outlet. <br />Boswinkel moved. Pillsbury seconded, to recommend to the <br />Board the drafting of an ordinance to clarify the code definition <br />of a commercial marina, per the letter from Attorney Leievere <br />dated July 2, 199U. Motion carried unanimously.
