A RESOLOTION GRANTING <br />A VARIANCES TO <br />MDNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 & 2 <br />FILE #1582 <br />WHEREAS, Carol Burgess (hereinafter "the applicant") is <br />owner of the property located at 2800 Pheasant Road within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Exhibit A, Attached, (hereinafter "the property"); <br />WHEREAS, the applicant has applied to the City of Orono for <br />a variance to Municipal Zoning Code Section 10.22, Subdivisions 1 & 2 <br />to permit the construction of 3 season porch and upper level deck <br />additions, such porch and decks encroaching past the defined average <br />lakeshore setback line where no encroachment is normally allowed , and <br />such additions comprising hardcover in the 75-250' lakeshore setback <br />zone in excess of 25% hardcover normally allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1582. <br />2. The property is located in the LR-IB Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />August 20, 1990 and recommended approval of the proposed <br />variance on a vote of 5 to 0, base ’ upon the following findings: <br />a. Because this house is on a peninsula, the average <br />lakeshore setback line is outside of the property <br />boundaries. The proposed additions are no nearer the <br />shoreline than the neighboring residence to the west. No <br />lakeviews enjoyed by that neighboring property owner will be <br />affected by these additions. The other abutting neighbor, <br />adjacent to the lagoon, is so far distant that the impact of <br />the view encroachments is insignificant. <br />b. Approximately 3/4 of the dry buildable acreage on this <br />2-acre property are in the 0-75' zone. Because of this, the <br />75-250' zone Is relatively small in relation to the total <br />lot area. Existing hardcover in the 75-250' zone is 35.5%. <br />Although the proposed additions increase structural <br />hardcover on the property by 114 s.f. or 0.5%, there are <br />areas of landscaping hardcover that can and should be <br />Page 1 of 4
