CITY <br />City of OROIVO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1688________ <br />_ _ _ 4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission* reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health* safety <br />and welfare of the community. <br />5. The City Council finds that the conditions existing on <br />this property are poco 1 iar to it and do not apply generally to <br />other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions* <br />light* air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant* but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS* ORDER AND CONDITIONS <br />Based upon the abov’e findings, the Orono City Council hereby <br />grants a variance to the ^^unicipal Zoning Code Section 10.22* <br />Subdivision 2 to permit the ccnstructicn of a deck which will increase <br />hardcover in the 75-250* setback zone f rom 6*698 square feet (or 24%) to <br />8.044 square feet or (29%) wher»' only 7*018 square feet (25%) is <br />allowed* subject to the following conditions: <br />1. The hardcover allowed by this variance is in excess of <br />the 25 percent allowed in the 75-250* foot setback zone. The <br />applicant is hereby advised that the City will not approve <br />any future improvements that result in additional <br />hardcover, and that if such improvement.*? are proposed* that <br />they be counterba lanceil with the removal of existing <br />h.i . <br />2.
