Cuff Letter Dated 8/20/90 <br />ISSUE - Determine if Council desires to initiate further process <br />given receipt of a 35% petition of the people in the area. <br />INTRODUCTION - In February of 1989 the Cuff's made a request for <br />the City to explore a storm water drainage project to alleviate a <br />water problem in the neighborhood. The City undertook a <br />feasibility study, as noted in Attachment A, predicated upon the <br />Cuff's paying half of the cost if the project did not go ahead. <br />That was agreed to and the feasibility study undertaken. In May <br />of 1989 it was determined that before the Council would proceed <br />further that a 35% petition of neighbors had to be received. <br />Earlier this year the attorney for the Cuff's requested that the <br />City proceed with the project in the absence of the 35% petition. <br />This was discussed at the the Council's May 29, 1990 meeting and <br />the result was that Council directed staff to see if alternative <br />private methods could be worked out. Staff visited the site and <br />discussed the issue with Mr. Cuff. Attachment C outlines the <br />proposed solution. <br />On Thursday, August 9, 1990 the City received a 35% petition from <br />the Cuff's indicating their desire to go ahead with the public <br />project. The City had received previously, on July 30, 1990 a <br />request for refund of selected assessment amounts on the property <br />purchased by the Cuffs. This issue will be handled as a separate <br />consideration at a later date, however, their request does relate <br />to the water problems on the property. <br />Karen Cuff has indicated that there are other property owners who <br />have water problems in the area and this is why they agreed to <br />sign the petition at this time as noted. <br />DISCUSSION - The following process would be similar to the public <br />improvement process proposed on the Stubbs Bay sewer: <br />Project Petition <br />Verification of petition signatures <br />k>nd Specifications
