CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.7545 <br />1 <br />A RESOLUTION APPROVING <br />A CONDITIONAL USE PERMIT PURSUANT WITH <br />MUNICIPAL ZONING CODE <br />SECTION 78-1279 <br />FILE NO. LA24-000060 <br />WHEREAS, on October 23, 2024, TVL Studios (hereinafter the “Applicant”), applied for a <br />conditional use permit from the City Code for the property addressed 755 Tonkawa Road and <br />legally described within Exhibit A; and <br />WHEREAS,the Applicant made an application to the City of Orono for a conditional use <br />permit from Orono Municipal Zoning Code Sections 78-1279 to construct new and replacement <br />retaining walls as a part of a deck replacement within the lakeshore setback; and <br />WHEREAS,on November 18, 2024, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br />WHEREAS,on November 18, 2024, the Planning Commission voted 5 to 0 in favor of a <br />motion to recommend approval of the conditional use permit as recommended by staff; and <br />WHEREAS,on December 9, 2024, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the application for a conditional use permit to construct new and replacement <br />retaining walls as a part of a deck replacement within the lakeshore setback and described <br />above based on one or more of the following findings of fact concerning the Property: <br />FINDINGS OF FACT: <br />A1. The analysis contained within staff memos and the exhibits attached to the aforesaid <br />memos, all minutes from the above-mentioned meetings, and all other materials <br />distributed at these meetings are hereby incorporated by reference. <br />A2. The Property is located in the LR-1B (One-Family Lakeshore Residential) Zoning <br />District. <br />A3. The lakeside slope on the Property is not defined as a Bluff. <br />316
