<br /> <br />232860v1 <br /> <br />44 <br />than thirty (30) days after the end of a given quarter shall be delinquent and <br />shall immediately thereafter accrue interest at the same rate and under the <br />same terms as late Franchise Fee payments as set forth in Section 7(1) of the <br />Franchise. Enforcement of unpaid PEG Fees shall be handled in accordance <br />with Section 9(7) of the Franchise, however, Grantee shall in all cases be <br />subject to interest on any payment more than thirty (30) days after the end of a <br />given quarter. <br />(e) Within thirty (30) days after receipt of notice from the City, Grantee shall pay <br />City up to Seventy-Five Thousand and no/100ths Dollars ($75,000.00) as a <br />capital equipment grant ("Grant"). Said Grant may be payable in multiple <br />draws over the course of the term as long as each draw is preceded by thirty <br />(30) days written notice from the City and the aggregate amount of the Grant <br />does not exceed Seventy-Five Thousand Dollars and no/l00ths ($75,000.00). <br />Grantee shall recoup said Grant by retaining the PEG Fee until such time as <br />the capital grant above is recouped. Upon such recoupment, Grantee shall <br />notify the City and Grantee shall thereafter pay the entire PEG Fee payment to <br />the City. <br />(7) Service to Public Buildings. <br />(a) Throughout the term of this Franchise Grantee shall provide, free of charge, <br />one (1) service Drop, one outlet, one (1) Converter, if necessary and requested, <br />and Basic Cable Service and the next highest penetrated level of Cable Service <br />generally available to all Subscribers (as of the Effective Date referred to as <br />Expanded Basic Cable Service) ("Complimentary Service"), to two sites which <br />shall be listed on Exhibit F attached hereto and updated from time to time. City <br />shall be responsible for the cost of internet services in the event they are <br />required to receive Grantee’s services via Internet Protocol Television (IPTV). <br />(b) The City or the building occupant shall have the right to extend Cable Service <br />throughout the building to additional outlets without any fees imposed by <br />Grantee for the provision of such service to such additional outlets except for <br />the cost of additional terminal equipment required to receive the signals. <br />(c) Notwithstanding anything to the contrary set forth in this section, Grantee shall <br />not be required to provide Complimentary Service to such buildings unless it <br />is technically feasible. <br />(d) Grantee shall, in any public building hereinafter built, provide all Drop <br />materials, design specifications and technical advice to provide service to a <br />demark point at such building. If the Drop line to such building exceeds five <br />hundred (500) feet the City or other agency shall pay the Actual Cost of such <br />Drop in excess of five hundred (500) feet. <br />(e) Two-way capability allowing for live transmission of PEG programming <br />upstream to Grantee’s Headend shall be provided to the public buildings listed <br />in Exhibit G at Grantee’s expense. <br />109
