As you know, a considerable amount of <br />time was expended with the defendant and his attorney, <br />Leroy Haugl£md, prior to negotiating the disposition of <br />the cheurge. Finally, however, the defendant did enter a <br />plea of guilty to the charge of maintaining a public nuisance. <br />Thereafter, Judge Henry McCarr certified the charge <br />as a petty misdemeanor and accepted the plea of guilty. <br />Judge McCarr then stayed the imposition of a sentence until <br />August 15, 1977. No sentence will be imposed against the <br />defendant if he complies with the following two conditions <br />prior to that date: (1) Mr. Primus must complete the drain <br />field for the house at 4520 Bayside and make it availaole for <br />your inspection and (2) he must open up the drain field at <br />the house at 4740 Bayside and make it available for your <br />inspection. If one or both of these conditions have not been <br />satisfied by August 15, Mr. Primus must reappear at which time <br />he will be sentenced. If, however, the conditions have been <br />satisfied, the conviction will be discharged and dismissed.
