E <br />CITY <br />OF <br />ORONO <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2292_ _ _ _ __ <br />HHBRBASr the applicants have applied to the City of Orono <br />(hereinafter "the City") for after-the-fact variances seeking approval of <br />land alterations conducted within 0 to 75 feet of the lakeshore of Lake <br />Minnetonka where none is allowed per Section 10.22, Subdivision 2 and <br />Section 10.55, Subdivision 8 and a height variance of 9 feet for the <br />existing principal structure where only a maximum allowed height of 30 feet <br />is allowed per Section 10.28, Subdivision 5 (A) and an after-the-fact <br />conditional use permit per Section 10.03, Subdivisions 19 and 20 for Ian <br />alterations not authorized under Orono Resolution No. 2172 or Orono <br />Building Permit No. 6385 conducted within the lakeshore protected area and <br />within 75 to 250 feet of the shoreline; and <br />WHBRBAS, the City Council has reviewed the application; the <br />recommendations of the staff and Planning Commission, the comments and <br />written statement submitted by the neighbor, the comments and written <br />statements of the applicants, applicants' attorney, and the applicants <br />site planner. <br />NOM, THBRBPORB, BE IT RESOLVED, that the City Council of the City <br />of Orono hereby denies the after-the-fact application as described above <br />based upon one or more of the following findings of fact concerning this <br />property: <br />FINDINGS <br />Yhs property is located in the LR—1C, Lakeshore Residential^ Zoning <br />District and consists of 32,308 s.f. or .74 acres. The District <br />requires 21,780 s.f. or .5 acres in area. <br />2. Prior to the restoration of the property, the former principal <br />structure was located 59 feet from lakeshore and hardcover <br />improvements were recorded as follows on the property; <br />0-75* o 7.1%, Allowed = 0% <br />75-250' = 28.1% Allowed = 25% <br />250-500' <= 12%, Allowed = 30% <br />3. The former residence was approximately 16 feet above the elevation <br />of the lakeshore and was situated at the highest point on a bluff or <br />lakeshore bank. Two timber retaining walls were installed in the <br />southwest corner/lakeshore of the property approximately 15 and 30 <br />feet in length and a single stone retaining wall approximately 20+ <br />feet to the east and 40 feet in length providing structural support <br />for the lakeshore bank. <br />Page 2 of 13
