Kallberg <br />August 8, 1990 <br />Page 2 <br />Although these requirements may seem excessive for such <br />a small addition, the City has on several occasions encountered <br />persons who, even when told to stop and get a permit, have <br />continued working on their improvements, in the mistaken belief <br />that once construction was completed, the City would be more <br />likely to allow the improvements to remain even if they didn't <br />meet code requirements. If the City allowed this to continue, <br />people would begin to ignore the regulations to an even greater <br />degree, which would defeat the whole purpose of limiting <br />structure and hardcover in the 0-75 foot zone. <br />In order for your requested improvements to be given <br />full consideration in the same manner an many other similar <br />requests throughout the community, I would encourage you to <br />provide the necessary survey and hardcover information. If it is <br />determined by staff that your improvements do not meet zoning <br />code requirements, you certainly have the option of applying for <br />a variance, as have literally dozens of other lakeshore <br />homeowners. If however, the variances required and you do not <br />fee^ that it is worth the time and expense to apply for one, I <br />recommend that you have the improvements removed, since they <br />would in that case constitute a violation of the City's zoning <br />code. <br />In your letter you indicated that you had a difficult <br />time with the City staff in dealing with this matter. It is my <br />understanding you have only had one opportunity to talk to them <br />and they remain at your disposal for a phone call or appointment. <br />Please feel free to contact either Mike Gaffron, Jeanne Mabusth <br />or Mark Bernhardson our City Administrator, to discuss your <br />project in detail.
