Public Facilities - Zoning <br />August P, 1990 <br />Page 4 of 4 <br />4. Limit all units of government, including the City, to <br />the same categories as one would find for a private <br />enterprise. <br />5. Split consideration as to allow zoning by whether the <br />facility serves essentially a local Orono purpose. A non- <br />Orono/regional purpose would have greater limitations as to <br />the districts that those would be allowed. <br />ACTION - <br />1. <br />2. <br />Discuss to determine desired Council direction. <br />Table for further discussion. <br />RECOMMENDATION - <br />The following represent recommendations; <br />A) Clarify language by indicating that municipal facilities <br />allowed in residential zones are only those for the City of <br />Orono. <br />B) Amend the conditional use permit for public utilities to <br />allow those deemed appropriate, primarily for local use of <br />the C:.ty of Orono, excluding structures/above ground <br />structures not specifically serving Orono from residential <br />districts. (It may be desirable to split consideration <br />between governmentally owned utilities and privately owned <br />utilities such as telephones, electric and gas.) <br />C) Specifically limit above ground structures such as <br />office buildings to business zones and uses similar to light <br />industrial uses by other governmental units to industrial <br />zones and only as conditional uses. <br />D) Limit facilities of educational institutions, research <br />institutions, e‘c. that are apart from schools within their <br />own judicial boundaries to the RR-lB-1 zone or in a business <br />zone subject to a conditional use. <br />E) Look at receiving a fee in lieu of taxes as part of a <br />conditional use for facilities that become tax exempt. <br />As a related item, scheduling on on-site visit is currently <br />being arranged and hopefully a date will be presented at the <br />Council meeting. <br />Proposed Motion - moved by ___, seconded by ___, that the Council <br />after discussion give staff direction for development of draft <br />language to be presented at the Planning Commission meeting for a <br />public hearing.
