A. For those four lakes the City has not e.stablished <br />lake zones around them so that the various lake setbacks <br />found on Long Lake and Minnetonka do not apply to these <br />lakeSf apart from the 26* wetlands setback. <br />The classification of lakes may in fact create a greater setback <br />requirement than the City's 75* setback if they are determined <br />-natural environment lakes". ThLs may have a severe impact on <br />the developability of currently developed properties plus those <br />that may in the future develop. <br />The agreement, as such, would have the City working directly DNR <br />in establishing requirements for those four plus Long Lake. <br />Should the Council choose to deal with DNR directly it is <br />anticipated that the City woulu still be dealing with the same <br />regulations for Lake Minnetonka whether it is though the LMCD or <br />the DNR but it may not have as much clout singly as it would <br />jointly through LMCD. This may be particularly in light of the <br />City wanting changes that LMCD may accept but the DNR, because <br />Orono is not participated with LMCD, may not be as inclined to <br />accept. <br />It is estimated, depending on the classification and development, <br />that such a project for a private consultant to assist would take <br />up to or to the expected reimbursement cut could be considerably <br />less if those classifications do not place too restrictive a <br />burden on development of abutting properties. <br />ALTERTNATIVES - <br />1. Adopt the agreement. <br />2. Propose changes. <br />3. Take no action. <br />4. Choose to deal with DNR directly on all shoreland regulati *^s. <br />5. Table for further discussion. <br />RECOMMENDATION - It is expected that the City would work through <br />LMCD as much of the staff work for their regulations has been <br />done but the dealing independently with DNR on the entire amount <br />may take considerably more time. Additionally it is requested <br />that the City be allowed to work with Dahlgren, Shardlow and Uban <br />in the development of standards for the other five lakes in the <br />community. This item is currently not budgeted specifically but <br />money would be available in 'SO and could be budgeted in Si. it <br />may be appropriate to add a line to the proposed resolution that <br />such joint participation does not obligate the City to have their <br />land use controls at all subject to LMCD. <br />It is recommended at this time, however, that it be tabled for <br />further review by the City Attorney and await the next draft of
