Proposed Revised Ordinance <br />ISSUE - Determine if the Council desires to make amendments <br />proposed by the City Attorney, <br />INTRODUCTION - Council adopted an ordinance regarding a change in <br />the park dedication fee at its March 26, 1990 meeting. Because <br />of irsues raised in conjunction with that consideration the City <br />Attorney reviewed again the Ordinance and has made some suggested <br />changes to that. <br />DISCUSSION - The changes as noted in the Attachment are as <br />follows I <br />1. Change cite in Ordinance to conform to 1989 <br />codification. <br />2. Indicate the City has the ability to determine that <br />wetlands are an optional consideration. <br />3. Clarification as to final determination as to amount. <br />4. Clearly indicate that the value is pre-development <br />value. <br />5. Further rights of appeal in accordance with case law. <br />6. Clarification as to time for determination of fee. <br />/ <br />7. Determination as to whether this applies to ^11 <br />applications not given preliminary approval by May 1st <br />or to applications received after May 1st. <br />Part of these recommendations were incorporated in the motion <br />as noted in the minutes.
