CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> t)A <br /> CZ <br /> y�l NO. 7533 <br /> .kESHoo' <br /> A RESOLUTION <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTIONS 78-350; 78-1279; and 78-1680 <br /> FILE NO.LA24-000053 <br /> WHEREAS, on September 17, 2024, on behalf of the property owner, K E Levitt Et Al Rev <br /> Trust, Lecy Brothers Homes & Remodeling (hereinafter the "Applicant")applied for variances from <br /> the City Code for the property addressed 700 North Arm Drive and legally described as: <br /> Lot 2, Auditor's Subdivision No. 362, Hennepin County, Minnesota (hereinafter the <br /> "Property"); <br /> WHEREAS, the Applicant has made an application to the City of Orono for variances to <br /> Orono Municipal Zoning Code Section 78-350 to allow redevelopment of an existing lot that <br /> property area is 0.44 acre where 1.0 acre is required and width is 140 feet at the lake and 130 <br /> feet wide at the 75-foot setback where 140 feet in width is required; and <br /> WHEREAS, the Applicant has made an application to the City of Orono for a variance to <br /> Orono Municipal Zoning Code Section 78-1279 to allow the construction of a new two-story <br /> home to be built on the existing home's footprint, 62.9 feet from the lake, including a deck set <br /> back 61.4 feet from the lake; and <br /> WHEREAS, the Applicant has made an application to the City of Orono for a variance to <br /> Orono Municipal Zoning Code Section 78-1680 to reconfigure the hardcover within the 75-foot <br /> lake setback allowing 866 square feet of hardcover in the 75-foot setback where 1,118 square <br /> feet of hardcover currently exists in conjunction with redevelopment of the Property; and <br /> WHEREAS, on October 21, 2024, after publishing and mailing notice per Minnesota <br /> Statutes and the City Code, the Planning Commission held a public hearing, at which time all <br /> persons desiring to be heard concerning this application were allowed to speak thereon; and <br /> WHEREAS, on October 21, 2024, the Planning Commission recommended approval of <br /> the variances as applied; and <br /> WHEREAS, on November 12, 2024, the City Council voted 3 in favor and 1 opposed on a <br /> motion to approve the variances as applied and directed Staff to prepare findings for approval of <br /> the variances. <br />
