Zoning File #1429 <br />August 21, 1989 <br />Page 2 of 2 <br />Applicant requested and has been provided with copies of the <br />pertinent ordinance sections and Comprehensive Plan excerpts <br />relating to work in lakeshore areas. The ordinances generally <br />prohibit walk-out excavations such as that proposed, requiring a <br />variance (supported by a hardship) to do so. The Comprehensive <br />Plan generally indicates that grading in lakeshore bank areas <br />should be avoided. Applicant is aware of the City's history of <br />denial of recent similar applications, but feels his property has <br />unique circumstances which justify his request. <br />Staff Recommendation - <br />The Planning Commission recommendation for denial appears to <br />be consistent with the general philosophy of the Comprehensive <br />Plan and consistent with the City's past practice in similar <br />situations. Applicant has requested to make a short presentation <br />to the Council at your meeting, and has provided excellent <br />graphic depictions of what he proposes. <br />Staff will dra£t a resolution reflecting Council's final <br />action, for your next meeting.
