existed on the property one boat dock; that said boat dock had <br />been constructed by a previous owner and was a lawful, non <br />conforming use on subject property at all times relevant herein. <br />IV. <br />That the existing boat dock on the subject property was used <br />by an adjacent neighbor named Glenn Tillotson whose address is <br />1875 Shadywood Road; that Tillotson used the boat doc on <br />Plaintiffs' property with permission of Plaintiffs. <br />V. <br />That sometime in 1988 Plaintiffs caused a second boat dock <br />to be constructed adjacent to subject property; that thereafter <br />in May of 1988 representatives of Defendant contacted Plaintiffs <br />and advised them that the second boat dock was not a permitted <br />use; that following meetings with City staff, including Zoning <br />Administrator Jeanne A. Mabusth, Plaintiffs were advised to apply <br />for a "lot area variance" for subject property; that Plaintiffs <br />were advised by Mabusth that this administrative step was <br />necessary for consideration of the second dock; that administra <br />tive memorandum issued by Mabusth indicate that although <br />Plaintiffs were advised and directed to make the lot area vari <br />ance, there was no real possibi.lity of the application being <br />successful, that the purpose of the application was to bring the <br />issue to the forefront and to determine what beneficial use of <br />the property would be permitted by Plaintiff. <br />VI. <br />That Administrator Mabusth advised Plaintiffs that <br />Defendant's existing Ordinances required all boat docks to be <br />-2-
