involvement of the LMCD or its Advisory Committee <br />Paragraph 1, sentence 6. "And in fact, we understand that the <br />Metropolitan Council has a committee about to engage in a <br />repetition of the planning which you have attempted to complete <br />in your own plan." <br />RESPONSE: We know of no such effort and have been unable to <br />verify Orono's contention. The Council is participating in a <br />multi-agency planning effort on the Mississippi River. There is <br />also discussion of a study of metropolitan-wide lake management, <br />following recommendations (in part) of the C zens League's <br />recent report. We believe the City is in error. <br />Page 1, paragraph 2. "With this in mind, we believe that the <br />section on Authority beginning on page 7 of the draft and <br />continuing through page 8 should be revised in its entirety and <br />that any other areas of the draft purporting to rely upon the <br />Metropolitan Council to give validity to actions of the LMCD <br />should also be removed. <br />RESPONSE: Since the City of Orono now recognizes the <br />authority of the LMCD to pinpare the Management Plan, the most <br />pressing issue has been removed. The discussion on pages 7 and 8 <br />have been reviewed by the Metropolitan Council. Changes were <br />made in earlier drafts at the request of the Metropolitan Council <br />to clarify their authority. We are inclined to rely on LMCD <br />counsel and the Metropolitan Council for the interpretation of <br />extant authority. <br />We recommend no change to pages 7 and 8. <br />Page 1, paragraph 3, sentence 1. "If the LMCD chooses to submit <br />the plan to the Metropolitan Council as a courtesy, it should <br />clearly state that it is only done with that in mind." <br />RESPONSE: The LMCD, indeed, did submit the plan to the <br />Metr politan Council as a courtesy. We also requested review <br />under M.S. 473.175, Subd. 1. That gives the Metropolitan Council <br />the authority to review the plan and to mediate disputes between <br />interested parties (Subd. 2). That was done in April, 1990. <br />Page 1, paragraph 3, sentence 2. "What the LMCD chooses to do <br />with any comments it receives is up to the LMCD." <br />RESPONSE: We agree. We recommend no changes to the <br />Management Program as the result of the first three parc.graphs of <br />Orono's Attachment A.
