ORDINANCE NO. SECOND SERIES
<br />AN ORDINANCE AMENDING SUBDIVISIONS 1, 2(H), 2(1), 3, 3(B), 3(F),
<br />3(G), 4 and 5(B), OF SECTION 5.30 ADOPTED APRIL 1, 1984, AND
<br />ENTITLED "SOLICITORS"
<br />The City Council of the City of Orono ordains:
<br />Ordinance No. 5.30 Subdivisions 1, 2(H), 2(1), 3, 3(B),
<br />3(F), 3(G), 4 and 5(B) adopted April 1, 1984 and entitled
<br />"Solicitors" is amended to read:
<br />Section 5.30. SOLICITOR AND TRANSIENT MERCHANTS
<br />Subd. 1. Purpose. This.Section is not intended to in
<br />any way hinder, delay or interfere with legitimate business or
<br />organizational activities. The Council finds, however, that
<br />solicitors have used public streets and their direct contact with
<br />residents of the City for the illegitimate solicitation practices
<br />of harassment, nuisance, theft, deceit, or menacing, troublesome
<br />or unlawful activities. This Section is intended to ferret out
<br />and control: (1) businesses and organizations using solicitation
<br />as a means of concealing unlawful activities; and, (2) businesses
<br />and organizations which, though its activities be lawful or even
<br />commendable, use such illegitimate practices in solicitation;
<br />and, (3) individual natural persons who, though they represent
<br />lawful business and organizations, use such illegitimate
<br />solicitation practices; and, (4) businesses and transient
<br />merchants, though legitimate, which cause, or are likely to
<br />cause, a traffic hazard or other inconvenience or danger to
<br />persons or property. The Council further finds^ that a large
<br />number of the residents of the City are employed as their
<br />livelihood and means of support by manufacturing plants and other
<br />businesses on shifts rotating between night and day, and to
<br />disturb them during their sleeping hours for the purpose of
<br />solicitation is a source of nuisance or even harassment and
<br />should be subject to control.
<br />Subdivision 2. Definitions.
<br />H. "Transient Merchant Activities" means engaging
<br />in any temporary, intermittent, or transient sales or exchanges
<br />of any goods, wares, or services by setting up any outdoor stand
<br />or structure, or by using any truck, automobile, or any other
<br />vehicle, at any point or place in the City.
<br />I. "Transient Merchant" means any person engaging
<br />in transient merchant activities.
<br />Subdivision 3. Prohibited Solicitation and Transient
<br />Merchant Practices.
<br />B. It is unlawful for any solicitor or transient
<br />merchant to practice harassment, nuisance, theft, deceit, or
